MTC/McDonough Telephone Promotional Giveaway and Sweepstakes Terms and Conditions Sponsored by MTC Communications, a subsidiary of McDonough Telephone Cooperative (MTC), located at 210 N Coal Street, Colchester, IL 62326.

Eligibility: Promotional giveaways and sweepstakes are only open to McDonough Telephone Cooperative members and customers of MTC Communications, who are age eighteen (18) or older at the time of entry. Employees, persons living in the same household, immediate family members of employees (spouse, parents, siblings, and children) of MTC and McDonough Telephone (“Sponsor”) are not able to enter or win. Giveaways/sweepstakes are subject to all applicable federal, state and local laws and regulations and is void where prohibited by law. Entrant may be required to have social networking accounts on various social networking platforms, i.e. Instagram, Twitter and Facebook (collectively “Social Media”) in order to enter the Giveaway/Sweepstakes via Social Media. Entrants are required to comply with all respective Social Media platforms (Facebook, Instagram, & Twitter) rules and regulations when posting on Social Media platforms and are prohibited from spamming or creating fraudulent or multiple accounts. By posting on any Social Media platform, Entrant agrees to release and hold harmless the applicable Social Media platform, its parent companies, subsidiaries, affiliates and related companies, and each of its officers, directors, employees and agents (collectively, “Social Media Released Parties”) from and against any and all liability. The Social Media platforms and the Social Media Released Parties are in no way connected or affiliated with Giveaway or Sweepstakes, Sponsor. Entrant must acknowledge that this Giveaway or Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram, or Twitter. By participating in this Giveaway or Sweepstakes you agree to a complete release of Facebook, Instagram, or Twitter from any claims. Entrants may only enter the Giveaway/Sweepstakes once. Multiple entrants are not allowed to use the same email address, same social media account, or same phone numbers. Any attempt by an entrant to acquire more than one (1) entry during the Promotion Period by using numerous email addresses, registrations, identities, or any other methods will void that entrant’s entry and that entrant will be disqualified.

Winner will be selected in a random drawing conducted by the Sponsor from among all eligible entries received by the end of the Promotion Period. Odds of winning depend upon the number of eligible entries. Winner agrees to be bound by these Official Rules and decisions of the Sponsor, whose decisions are final on all matters relating to this Giveaway or Sweepstakes.

Notification of Winners: Winners will be notified by telephone, mail, email, and/or direct message via social media within the specified number of business days of the Prize drawing, and may be required to sign and return an affidavit of eligibility and publicity/liability release within three (3) days of notification. Prize will be forfeited if a selected Winner cannot be contacted, is ineligible, fails to claim all or a portion of a prize or, where applicable, an affidavit of eligibility and publicity/liability release is not timely received, is incomplete or modified. In the event of a Prize forfeiture, an alternate winner will be selected from remaining valid, eligible entries that were timely submitted. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the e-mail/social media account specified in the entry. “Authorized account holder” is defined as the natural person who is assigned to the social media account and/or an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

All federal, state, and local taxes are the sole responsibility of the winner. Winner will receive an IRS Form 1099 reflecting the final actual value of any Prize valued at $600 or more. Consult with your tax professional regarding potential tax implications. Should the ARV of the Prize equal or exceed $600.00, winners shall provide to Sponsor their social security number and tax information for issuance of a 1099 Form.

Privacy Policy: Any personal information supplied by you to McDonough Telephone and MTC will be subject to MTC’s privacy policy posted on MTC’s Regulatory page: http://mdtc.net/resources/regulatory/. Notwithstanding the foregoing, and to the extent applicable, by entering the Giveaway/Sweepstakes and by opting in (providing an question/comment on the Giveaway/Sweepstakes photo) if applicable to any Giveaway/Sweepstakes offers on the landing page, you grant MTC permission to share your email address with the corresponding Sponsor if applicable. Accordingly, your personal data will then be subject to the corresponding Sponsor’s Privacy Policy. Additionally, by entering the Giveaway/Sweepstakes you understand that McDonough Telephone and MTC may send you additional commercial marketing email regarding McDonough Telephone Cooperative (MTC), and its partners.

WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY OR SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON THE FULLEST EXTENT PERMITTED BY LAW.

Disputes and Jurisdiction: Disputes arising from this Giveaway/Sweepstakes, or any matter arising therefrom, whether direct or indirect, will be determined according to the laws of the State of Illinois, without reference to its conflict of laws principles. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Giveaway/Sweepstakes shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims, and causes of action arising out of or connected with this Giveaway/Sweepstakes shall be resolved exclusively by the United States District Court of Central Illinois sitting in Peoria County or the Circuit Court of McDonough County; and (iii) under no circumstances will Entrants be entitled to, and Entrants hereby waive all rights to claim, any punitive, incidental and consequential damages and any and all rights to have damages multiplied or otherwise increased; SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules and Regulations, or the rights and obligations of the Entrants or the Sponsor in connection with the Giveaway or Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.

General Terms: By entering this giveaway/sweepstakes, you promise to abide by the Official Rules and decisions of Sponsor, which will be final and binding in all respects. Sponsor reserves the right, at its sole discretion, to refuse, disqualify or withdraw any entry at any time. Sponsor will not be responsible for any injury, damage or loss of any kind arising out of your participation in the Giveaway/Sweepstakes. YOU AGREE TO RELEASE, DISCHARGE, AND HOLD HARMLESS SPONSOR, ITS AFFILIATES, SUBSIDIARIES, EMPLOYEES, OFFICERS, DIRECTORS, AGENTS AND ASSIGNS FROM AND AGAINST ANY OR ALL CLAIMS, LOSSES, INJURIES, OR DAMAGES RESULTING FROM PARTICIPATION IN THE GIVEAWAY/SWEEPSTAKES.
